Right of withdrawal

Pursuant to art. 64 of Legislative Decree no. 206/2005, if the Customer is a consumer (ie a physical person who purchases the goods for purposes unrelated to the business or professional activity carried out, or does not make the purchase indicating in the order form a reference VAT number), has right to withdraw from the contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following articles 20, 21 and 22. The right of withdrawal does not apply to buyers who, by requesting the invoice subject holder of VAT, buy the goods for their business.

To exercise the right of withdrawal, the Customer must send a communication to FGV Service Centro-Sud, within ten working days from the date of receipt of the goods. This communication must specify the detailed list of the material that you intend to return with, attached, a copy of the tax documents for the delivery of the goods received, and be sent by registered letter with acknowledgment of receipt, addressed to:

or by fax or e-mail, always within the aforementioned term of ten working days. In this case, the withdrawal must be confirmed by the Customer by sending the notice of withdrawal by registered letter with acknowledgment of receipt, strictly within 48 hours following the forwarding of the communication by fax or e-mail. Once the notice of withdrawal has been received by registered letter with acknowledgment of receipt, FGV Service Centro-Sud will communicate to the Customer - by e-mail - the address to which the goods to be returned will be sent and will send an appropriate return form, which must be attached to the returned product together with the original receipt received with the goods. The Customer must send the product carefully packed in its original packaging to the address provided, avoiding damaging it with adhesive labels or other items, complete with all the contents contained in its packaging. The shipping costs for returning the goods are charged to the customer. The shipment by the customer must be made by courier within ten working days from sending the customer, by e-mail, the address to which the goods are to be shipped and the return authorization form. The shipment, up to the certificate of receipt by the FGV Service Centro-Sud, is under the responsibility and risk of the customer.

Upon goods receipts, FGV Service Centro-Sud will verify the integrity and it will refund the customer with the amount of the product purchased, excluding:

- transport costs;

-  commissions on the payment retained by the brokerage company of the payment (Paypal or credit card);

- amount of the VAT. (if the original receipt is not returned).

If the goods are received intact at the address indicated by FGV Service Centro-Sud, the refund will be made by bank transfer, on the current account indicated by the Customer in the notice of withdrawal, within thirty days from the goods receipt by FGV Service Centro-Sud.

The right of withdrawal can be exercised only with regard to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased. The right of withdrawal can not be exercised in relation to the supply of goods made to measure or clearly personalized or which, by their nature, can not be returned or are liable to deteriorate or expire rapidly. The purchased product must be returned intact and in the original packaging complete in all its parts (including packaging and any documentation and accessory equipment and individual disassembled components: manuals, assembly material, cables, screws, etc.) and together with the original invoice delivered with the goods. In all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided. In case of damage to the goods during transport, FGV Service Centro-Sud will inform the Customer of the event (within five working days from receipt of the product in its warehouses), to allow the Customer to raise timely objection against the courier from him chosen and obtain the reimbursement of the value of the product (if assured by the Customer). FGV Service Centro-Sud is not liable for damage, theft or loss of products returned by uninsured shipments at the Customer's expense.

The right of withdrawal ends in the event of a defect of the substantial integrity of the returned goods, and thus by way of example: i) lack of the external packaging and / or the original internal packaging; ii) absence of integral elements of the product (manuals, assembly material, cables, screws, parts, accessories, etc.); iii) damage to the product for reasons other than transport; iv) abnormal state of preservation; v) registration of products identified by a unique serial number made by the Customer to the Producer for the activation of the warranty or accessory services; vi) clear assembly and subsequent dismantling of products that constitute components and / or semi-finished products for use with objects owned by the customer; vii) elimination or tampering of labels and / or security seals and / or indication of use or assembly from the product. In case of forfeiture of the Customer from the right of withdrawal, FGV Service Centro-Sud will not be required to make any refund and will return the purchased product to the customer, charging the same shipping costs.
